I'm probably completely misunderstanding your point of view, or rather,
what is your point of view?
Not throwing the exception will turn a correct program into an incorrect one
if that program relies on the exception.
That's the case I'm most worried about, incorrect programs not so much.
I find them difficult to reason about, but maybe that's just me..
