I have not yet switch from 1.37 to 1.38 but I use the following user-config.jam to run the regression tests. Can you try with it? It has to be put in your home directory

using gcc : cygwin_4.3.2 : /usr/bin/g++-4 :
        <compileflags>-DBOOST_POSIX_API
        <compileflags>-DBOOST_POSIX_PATH
        ;

and bjam --with-toolset=gcc-cygwin_4.3.2
